Terms of Service

  1. Length of Service
    • No Minimum Sessions: Use our services as needed, without any obligation to continue.
    • Tailored Service: Customised to fit your unique needs.
  2. Services Overview
    • Consultation: Friendly chat to understand your needs.
    • Customised Plan: Develop a personalised organising plan.
    • Implementation: Collaborate to execute the plan.
    • Scope of Services:
      • Hands-on decluttering and organising support
      • Moving preparation
      • Downsizing
      • Deceased estate clearance
      • New home setup
      • Hoarding support
      • Decluttering support calls
      • Donation coordination
      • Paperwork sorting.
  3. Initial Review and Consultation
    • Discussion and Assessment: Detailed conversation to assess your needs and spaces.
    • Record-Keeping: Notes and photos with your consent.
    • Team Collaboration: Depending on the project scope, team members may attend the session.
  4. Business and Service Hours
    • Regular Hours: 9 a.m. to 5 p.m., Monday through Friday.
    • After-Hours Service: Additional fees for may apply for weekends and public holidays.
    • In-Person Sessions:
      • Minimum 3 hours in Sydney;
      • 4 hours outside Sydney or if travel time more than 45 minutes
  5. Fees, Payments, and Reimbursements
    • Charges: AUD, covering various services.
    • Exclusions: Fees exclude products, supplies, or third-party services.
    • No Charge Services: Appointment scheduling, feedback, and brief emails.
    • Payment Terms: Balance due at the end of the service. Various payment methods accepted.
    • Travel Reimbursements:
      • Fees may apply for travel exceeding 30 km or 90 minutes,
      • and $1/km if travel is required during a session eg travel to a storage unit or another home
    • NDIS Coverage: Costs covered for self-managed or plan-managed participants.
    • Accommodation: $150 per night for longer jobs requiring accommodation.
  6. Deposits, Quote Validity, and Package Expiry
    • Deposit: Required to secure your first booking.
    • Prepaid Package Offer: Valid for 7 days.
    • Prepaid Discount Package: Valid for 3 months, non-transferable.
  7. Late Payment
    • Administration Fee: $20 for overdue payments plus 2.5% fortnightly interest.
    • Collection Costs: Client responsible for all associated costs if collection agencies are involved.
    • Legal Action: Legal fees recoverable in case of a breach.
  8. Safety
    • Safety First: Ensuring a safe environment.
    • Responsibility for Pets and Children: Keep them away during sessions.
    • Reporting Unsafe Conditions: Inform us of any hazards.
    • Session Adjustments: Minimum 3-hour charge if a 4-hour or more booked session needs to stop unexpectedly.
  9. Respectful Environment
    • Respectful Interactions: We are committed to maintaining a respectful, inclusive, and supportive environment. We have a zero-tolerance policy for hate speech, bullying, harassment, and any form of abusive behaviour. All clients, subcontractors, and staff must treat each other with kindness, respect, and understanding, ensuring a welcoming environment for everyone. Violation of these terms may result in the immediate termination of services.
    • LGBT Inclusivity: Commitment to an inclusive and supportive environment.
    • No Hate or Bullying: Bullying includes, but is not limited to:
      • Verbal Abuse/Teasing: Insults or derogatory comments.
      • Exclusion or Isolation: Deliberately leaving someone out of activities or consistently favouring one staff member over another.
      • Humiliating Behaviour: Actions or words intended to embarrass.
      • Micromanaging: Excessive control or criticism.
  10. Privacy
    • Handling Information: Personal information used solely for service obligations.
    • Confidentiality: Your information remains confidential even after the relationship ends.
  11. Cancellations and Rescheduling
    • 48-Hour Notice: Please inform us at least 48 hours before if you need to cancel or reschedule.
  12. Late Notice Cancellation Fee
    • Cancellation Fee: 50% of the session rate may apply for cancellations less than 48 hours
  13. Timely Access and Delay Notifications
    • Timely Access: Ensure access within 15-20 minutes of the appointment.
    • Delay Notification: Please notify us beforehand of any delays.
  14. Working Together Effectively
    • Requesting Services: You have requested our services to provide guidance, support, and assistance with the organisation and/or decluttering of your home by:
      • i. Sending us an email and accepting our quote;
      • ii. Confirming acceptance by telephone
      • iii. Making a full or partial payment
    • Communication: Please speak up if at any time you feel uncomfortable or unsafe.
    • Readiness: Ensure you are ready to work when a professional organiser arrives.
    • Trust and Guidance: We request that you trust our capabilities and avoid providing excessive guidance. Too much direction may impede our productivity. Confidence in our skills will help us serve you better. We may feel uneasy if your expectations are overly demanding.
  15. Out of Scope
    • Deep Cleaning: Not responsible for heavily soiled areas.
    • Selling Items: Client in charge of sales, disposal, or giveaways.
    • Donation Policy: Limited to one trip per session.
  16. Third-party Services
    • Separate Agreements: Third-party services are separate agreements.
    • No Responsibility: Not responsible for third-party service quality.
  17. Warranty & Indemnification
    • Insurance Coverage: Covered by Professional Liability and Public Indemnity Insurance.
    • Indemnification: Client indemnifies Clear & Clutterfree against claims beyond our control.
  18. Dispute Resolution and Feedback
    • Dispute Resolution: Resolved through good faith negotiation.

  19. Australian Consumer Law
    • Consumer Rights: Bound by Australian Consumer Law Rights.
  20. Liability
    • Limited Liability: Limited to the repayment of the price paid.

    • New South Wales: This agreement is governed by NSW law.
  22. Acceptance
    • Client Agreement: By making a deposit, you agree to these terms.
    • Booking Deposit: Required to secure your appointment.
